Introduction to the Terms of Use
Our online store welcomes you. The terms and conditions below govern your use of this store and all legal effects arising from your use of the store’s services through this online platform. Any person’s use of the store, whether as a consumer of a product or service or otherwise, constitutes full acceptance of every provision of this agreement by a person who has the legal capacity to do so. This agreement governs all forms of dealings between the consumer and the store and becomes effective once you accept it and begin registering with the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.
Article 1: Introduction and Definitions
The introduction above is an integral part of this agreement. The principal terms used in it have the following meanings:
1. Store: all forms of the store online, including an electronic application, a website, or a physical shop.
2. Consumer: a person who engages in e-commerce to obtain products or services offered by the store through its electronic platform.
3. Agreement: these terms and conditions, which govern and regulate the relationship between the parties.
Article 2: Consumer’s Legal Capacity
1. The consumer confirms having the legal capacity required under Islamic law and applicable regulations to deal with the store, or being at least 18 years old.
2. If the consumer breaches this article, the consumer bears the consequences of that breach toward third parties.
Article 3: Nature of the Obligation
1. The store’s obligation toward consumers is to provide the requested service or product.
2. The store may provide additional services, including after-sales services, depending on the nature and type of service or product requested by the consumer.
Article 4: Rules of Use
1. The consumer must use the store’s electronic platform in a manner consistent with public morals and the laws and regulations in force in the Kingdom of Saudi Arabia.
2. When purchasing a service or product from the store, the consumer must not use it in any manner that violates public morals or the laws and regulations in force in the Kingdom of Saudi Arabia.
Article 5: Accounts and Registration Obligations
When applying for membership in the store as a user, you must disclose specified information and choose a username and confidential password to access the store’s services. You therefore agree to the following:
1. You are responsible for maintaining the confidentiality of your account information and password. You must immediately notify the store of any unauthorized use of your account or any other breach of your confidential information.
2. The store is not responsible for any direct or indirect material or non-material loss resulting from disclosure of the consumer’s username or password.
3. You must use your store account or membership yourself and remain fully responsible for it. Use by another person is evidence that you authorized that person to use the store in your name and on your behalf.
4. You must use the store seriously and in good faith.
5. You must provide true, accurate, current, complete, and lawful information as requested during registration and update it whenever it changes or when necessary.
6. The store undertakes to treat your personal information and contact details with complete confidentiality.
7. If the store determines that information you provided is false, inaccurate, outdated, incomplete, unlawful, or contrary to these Terms of Use, the store may suspend, freeze, or cancel your membership or account without prejudice to its other rights and lawful means of protecting its rights and other consumers.
8. Failure to comply with any of the above gives the store management the right to suspend or cancel your membership or block your access to the store’s services.
Article 6: Electronic Communications and Official Contact Channels
1. The parties agree that communications may be conducted through the email address registered on the platform.
2. The consumer agrees that agreements, notices, statements, and other communications supplied electronically have the same effect as their written equivalents and independently satisfy applicable legal requirements.
3. The consumer agrees that the store may contact the consumer and provide notices concerning this agreement or their dealings with the store through general messages sent to all consumers or messages sent to specified users.
Article 7: Amendments to the Terms of Use and Fees
1. If any article or provision of this agreement is cancelled or ceases to be effective, the remaining articles, provisions, rules, and terms remain valid until further notice from the store management.
2. This agreement, as amended from time to time when necessary, constitutes the operating framework, understanding, and agreement between the consumer and the store.
3. The store may charge fees to certain consumers depending on the offers, products, or services requested, or on fees and taxes imposed by the state according to the nature of the product or service.
4. The store reserves the right, in accordance with these Terms of Use, to add, increase, reduce, or discount fees or expenses applicable to consumers, regardless of the reason for registration.
Article 8: Payment and Settlement Services
1. Through its partners, the store provides payment and settlement options. Payment may be completed entirely online using the options available in the store or by any other method the store provides from time to time.
2. The store undertakes to set the price of an offered service or product in line with the generally accepted market value.
3. The store undertakes to provide invoices and receipts for amounts and proceeds arising through the store and to provide the consumer with a purchase invoice for a service or product.
4. The store undertakes to apply generally accepted accounting standards in its electronic store, in accordance with this agreement and the related legal, economic, commercial, and regulatory interests.
Article 9: Intellectual Property
1. The store’s intellectual property rights are owned in full by the store, whether acquired before or after the establishment of this electronic platform.
2. The consumer must respect the store’s intellectual property rights, including the store name, words, logos, symbols, and other material belonging to or displayed by the store. All rights associated with the store name are fully owned intellectual property of the store.
Article 10: Store Liability
1. The store undertakes to conduct its commercial activity through this electronic platform lawfully, in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia and with this agreement.
2. The store is not liable for claims arising from errors or negligence, whether direct, indirect, incidental, or caused by the consumer or by a third party such as a shipping company, to the extent permitted by applicable law.
3. The store, its personnel, owners, and representatives undertake that products and services will be lawful, safe, and authorized under the laws and regulations of the Kingdom of Saudi Arabia and used for lawful purposes.
Article 11: Restricting Access or Membership
The store may suspend or cancel a consumer’s membership or restrict access to platform services at any time, without prior notice, and for any reason, to the extent permitted by applicable law.
Article 12: Governing Law
These Terms of Use are governed by and drafted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and are fully subject to the regulations applied by the competent Saudi authorities.
Article 13: General Provisions
If any article or provision of these Terms of Use is cancelled or becomes unenforceable, this does not invalidate the remaining articles, provisions, and terms, which remain effective until further notice from the store management.
These Terms of Use, as amended from time to time when necessary, constitute the terms, operating framework, understanding, agreement, and contract between the store and the consumer. Both parties also agree to the following:
1. Arabic is the governing language when interpreting this agreement or translating it into another language.
2. Prices displayed for the store’s products or services may be amended from time to time.
3. Promotional or marketing offers made by the store are temporary. The store may amend or discontinue them at any time.
4. The parties must deal with one another in a manner consistent with Islamic principles and the applicable laws and regulations relevant to the nature of their dealings.
5. These Terms of Use may be terminated only by a decision of the store management.
